He was most likely testifying in his own defense for the murder trial of his wife Mary Emma James. He purportedly had an affair with his niece, which spurred him to tie down his wife and have a rattlesnake bite her, and then later drown her in their fish pond. He was supposedly helped by his friend, ex-sailor Charles H. Hope, who was also charged with murder.

Commissioners included: President Thomas Caldwell Ridgway, former president of the California bar association; Vice-chairs, USC Dean William Green Hale and Perry Evans of San Francisco; Secretary Fred B. Wood; Don G. Bowker of Los Angeles; Gerald Hanna Hagar of Oakland; Berkeley's Professor Alexander Marsden Kidd; Stanford's Professor William B. Owens, and Norris N. Montgomery of Santa Barbara. Hagar and Kidd's names are misspelled in the Los Angeles Times caption and nitrate negative captions.

At the time this photograph was taken, Harold G. Ferguson had served in San Quentin State Prison for the grand theft of investment funds in the 1929 sale of the Malibu La Costa beachfront properties--faciliated by his former real estate company the Harold G. Ferguson Corporation. After his release, Ferguson testified at this 1935 trial, in which the Malibu investors were ultimately denied the recovery of $443,000 from the Bank of America National Trust and Savings Association and the Marblehead Land Company, the third-party companies Ferguson used to broker the Malibu deals.
