Proposition 64 Protects Small Businesses from Frivolous Lawsuits

(Organization) has joined Arnold Schwarzenegger and Californians to Stop Shakedown Lawsuits -- a broad-based coalition of over one thousand businesses, chambers of commerce, community groups, non-profits, and taxpayers across that state -- in supporting Proposition 64. The initiative will close a loophole in CA law that lets lawyers file frivolous shakedown lawsuits.

Unique to California, this loophole lets private lawyers file frivolous lawsuits against small businesses even though they have no client or evidence that anyone was damaged or misled. Shakedown lawyers "appoint" themselves to act like the Attorney General and file lawsuits on behalf of the people of the State of California, demanding thousands of dollars from small businesses that can't afford to fight in court. Most of the time, the lawyers or their front groups keep all the money!

The shakedown lawsuit loophole has been used to file suits against thousands of small businesses like auto repair shops, restaurants and nail salons. For example, in a lawsuit against one auto repair shop, lawyers didn't claim that the shop broke the law, just that they might have. The business, lacking knowledge of their legal rights, was forced to pay the $2500 to settle or face the even higher cost of going to court.

Proposition 64 is common sense reform that will close the shakedown loophole while protecting the right of every consumer to file a lawsuit if they've been damaged. It allows the Attorney General, district attorneys and other public officials to file lawsuits on behalf of the People of the State of California to enforce California's unfair competition law. That way, the settlement money goes to the public, not the pockets of unscrupulous trial lawyers!

Send a Letter to the Editor

Tips for writing a letter-to-the-editor:

  1. Be brief and concise. The papers will often edit your letter down to a paragraph or a couple sentences. Letters should be no longer than 150 words.
  2. Focus your letter on one key point and personalize to make more of an impact (i.e., Small businesses are forced to settle or lawyers are the only beneficiaries).
  3. Include your name, phone number and address. Papers are unlikely to run anonymous letters and will need your contact information for verification.
  4. Make sure to reference the article you are commenting on. Include the title and the date of publication.
